Procedures for APS Investigations Group Homes

  1. Prior to initiating the investigation:
    1. Determine if the client(s) is a FOCUS CLASS MEMBER or has ever been a resident of Hissom. If yes refer report to the Office of Client Advocacy.
    2. Determine size of group home by consulting DDSD.
    3. May request DDS worker to accompany on investigation.
    4. Determine whether law enforcement will need to be involved.
    5. Decide whether more than one worker needs to be involved in the investigation.
    6. Determine, to the extent possible, where residents are during the day and when they return to the group home. May need to interview clients away from facility.
    7. Determine, to the extent possible, the legal status of the client(s) and contact legal guardian to advise of report. If guardian can not be reached proceed with the investigation.
  2. Facility visit:
    1. Ask to speak with the person administratively responsible for the facility who is currently on duty.
    2. Explain purpose of the visit and conduct interview with that person. Be prepared to present ID verifying your identity and position.
    3. Ask to review records of identified client(s). Check medication and financial records.
    4. Interview the client(s) privately.
    5. Interview the alleged perpetrator privately.
    6. Complete initial interviews with all clients on the same day to prevent staff interference in the investigation.
  3. Collateral Contacts:
    1. Interview anyone who has regular contact with the facility, who may have specific information regarding the report.
    2. Interview other residents and or former residents regarding conditions of client and facility.
    3. To the extent possible, have collaterals complete written statements. May consider taping the interview.
  4. Services:
    1. Determine need for medical evaluation of AV.
      • Client has injuries which have been untreated
      • Client alleges sexual abuse
      • Client has medication use problems
    2. Determine need for immediate relocation
      • Client is in danger at the facility
      • Client is presenting dangerous behavior problems (to self and/or others) as a result of the abuse, neglect, or exploitation.
  5. Denied Entrance or Access to Client:
    1. Advise that court order can be obtained.
    2. Advise that their contract with DDSD requires cooperation with an Adult Protective Service investigation, and non-cooperation will be immediately reported.
      • Contact APS State Office immediately
  6. Special Requirements Specific to Group Homes:
    1. If DDS worker assists in investigation, send a copy of the completed report to DDSD (APS2)
    2. APS 2 will also be sent to the Office of Client Advocacy
    3. NO INFORMATION WILL BE RELEASED regarding the results of the investigation without a court order instructing DHS to release, except to the group home director or board as provided for in in Policy.
    4. There are currently no appeal rights regarding APS decisions.
