Procedures for APS Investigations Sheltered Workshops or Day Care Centers

  1. Prior to initiating the investigation:
    1. Determine where client(s) reside.
    2. Determine where, how and when the participants will be interviewed.
    3. Determine how many workers will be necessary to complete the investigation.
    4. Determine whether DDS involvement is needed or desired.
    5. Determine legal status of clients involved if possible, and notify legal guardians if any were possible.
  2. Collaterals:
    1. May be desirable to interview collaterals both before and during the investigation.
    2. Interview caretakers at place of residence of participants. (Group home directors, parent, ICFMR staff, etc.)
    3. Interview participants who are not identified as AP’s.
  3. Facility visit:
    1. Inform the person in charge of the facility the reason for the visit and interview this person regarding the allegations.
    2. Review records regarding attendance, procedures, reimbursement etc.
    3. Interview identified client(s) regarding allegations.
    4. Interview alleged perpetrator regarding specific allegations.
    5. Interview other staff as needed to serve as collaterals.
    6. Observe and document conditions of the facility and what clients and staff were engaged in at the time of the visits.
    7. Review transportation arrangements, supervision, work requirements, hours, etc.
  4. Services:
    1. Emergency
      • Unmet medical need of clients
      • Unsafe, dangerous work conditions
      • Evidence that client(s) are being sexually abused or exploited
    2. Recommendations
      • Alternative means of discipline
      • Advising facility of civil rights violations
      • Suggestions for improved relations between facility and participants
  5. Special consideration:
    1. Results of the investigation may not be released without court order except to the facility director.
    2. Reports of this type may be politically charged. Care, tact and diplomacy are needed. Insure information is kept confidential. Discuss report with no one other than supervisor.
    3. Determine if any DHS staff are on the board of directors or advisory boards for the facility.
    4. Contact District Supervisor, or APS Field Representative with unusual developments.
  6. Follow-up
    1. Unsubstantiated: 30 day follow up
    2. Substantiated: Short-term to assure problem resolution
